LLP Antiplagiat.Kazakhstan, a company duly registered under the laws of the Republic of Kazakhstan bearing registration number 210440000453 and having its registered address at Bayzakova street, 280, Bostandyk district, Almaty, Kazakhstan, 050040, hereinafter Antiplagiat.Kazakhstan, with its Software assists students, teachers, researchers, and employees around the globe in text reuse      detection and creates new opportunities in education.

 

Antiplagiat.Kazakhstan sets high standards in regard to the Privacy of its Users:

  • adheres to the highest ethical standards;
  • strives to comply with the highest standards of confidentiality to gain the trust of its Users;
  • carefully protects the Users’ Personal Data;
  • uses Personal Data only established by operation of law.

This Privacy and Cookies Policy (also referred to as Privacy Policy) describes how Antiplagiat.Kazakhstan collects, uses, stores and protects the Personal Data in accordance with above-mentioned standards, and what choices Users have with respect to their Personal Data.

 

  1. Definitions

The following definitions are given either within the meaning of Regulation (EU) no. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter GDPR) as well as with due regard to Federal Law of the Russian Federation No. 152-FZ on Personal Data dated July 27, 2006, and taking into account the standards for the protection of Personal Data of the United States of America and Switzerland, Norway, Iceland, Liechtenstein or within the meaning and interpretation that established practice has assigned to such terms, definitions, and word combinations at work in the field of Internet technologies.

 

  1. Antiplagiat Services shall mean services on plagiarism detection provided under this Licensing Agreement.
  2. Site shall mean a set of web pages located on the Internet, united by a single theme, design, and a single address space of the domain antiplagiat.com and subdomains.
  3. User(s) shall mean person(s) who accesses the Site using the capabilities of the Site after completing the registration procedure.
  4. European Union Users shall mean Users who access the Site from the territory of the European Union and the European Economic Area.
  5. Data Subject shall mean an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  6. Personal Data shall mean any information relating to the Data Subject.
  7. Cookies shall mean small bits of record-keeping text information that are automatically created and stored in the User’s computer or other devices in order to associate and identify activity with the User.
  8. Controller shall mean a legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Data are, or are to be, processed. For the purpose of this Privacy Policy, Antiplagiat.Kazakhstan is a Controller of their Personal Data. Antiplagiat.Kazakhstan is also an operator under the law of the Republic of Kazakhstan.
  9. Processor shall mean any natural or legal person who processes the data on behalf of the Data Controller. Antiplagiat.Kazakhstan may use the services of various Service Providers in order to process their data more effectively.
  10. Processing shall mean a set of Processor’s actions in relation to the Personal Data of Users, regardless of its location in accordance with the established goals.
  11. Materials (Documents) shall mean information uploaded by Users to the Site in the form of texts and files.

 

  1. European Union Users and International Data Transfers

2.1. Antiplagiat Services are global by nature. Antiplagiat.Kazakhstan may transfer, process, and store some of the Users’ personal information on Antiplagiat.Kazakhstan servers or databases outside the European Economic Area (EEA). Whenever the Antiplagiat-Kazakhstan System transfers any information, Antiplagiat.Kazakhstan takes measures to protect it.

2.2. For the purposes of this Privacy Policy, Antiplagiat.Kazakhstan divides Users according to the principle of applicable requirements for the processing of Personal Data. Users of the Site are divided into European Union Users and Other Users. For European Union Users the requirements of the GDPR apply.

2.3. Antiplagiat.Kazakhstan may disclose Personal Data on a legitimate request from a public authority (for example, to satisfy national security or law enforcement requirements). Personal Data of European Union Users can be presented to the public authority only if there is a request issued in strict accordance with the requirements of the GDPR.

2.4. Data transmission of European Union Users is possible only if there is a direct express consent of a European Union User directly expressing their consent for such a transfer.

2.5. Antiplagiat.Kazakhstan does not transfer Personal Data to any third parties, except for the cases stated in the Section 3.

  1. Data Antiplagiat.Kazakhstan Collects and Receives

3.1. In order to provide Antiplagiat-Kazakhstan System Services, Antiplagiat.Kazakhstan may collect or receive data, which may include the information voluntarily provided in the course of filling in registration forms, the information provided during the registration process, requests made by the User for other services, or information collected automatically while      providing the services.

3.2. Data Users provide Antiplagiat.Kazakhstan with

3.2.1. Account Data

3.2.1.1. To gain access to the Antiplagiat-Kazakhstan System Services, the User must follow the registration process. After the User passes the registration procedure, Antiplagiat.Kazakhstan receives and starts processing Personal Data.

3.2.1.2. For the purposes of User registration Antiplagiat.Kazakhstan requests the following data: (i) e-mail address; (ii) password.

3.2.1.3. Antiplagiat.Kazakhstan requests above-mentioned Personal Data for the following purposes: sending system messages to the User including, but not limited to, resetting the password or sending important messages about the Antiplagiat-Kazakhstan System Services, for example, any changes in the functionality of Site and/or changes in legal and technical documents posted on the Site.

3.2.1.4. Upon completion of the registration procedure, the User may, at his own request, indicate:

  1. last name;
  2. name;
  3. middle name;
  4. profile image;
  5. Facebook social media account.

The above data will be processed and used for communication purposes between Antiplagiat.Kazakhstan and Users.

 

3.2.2. Anonymous data

Antiplagiat.Kazakhstan will also collect anonymized data about visitors and their use of Antiplagiat-Kazakhstan System Services for the purposes of creating aggregate statistics or reports. However, no single individual will be identifiable from the anonymized data Antiplagiat.Kazakhstan collects for these purposes.

 

3.2.3. Social Media Login

3.2.3.1. User registration is possible by transferring Personal Data from some social media (for example, Facebook). The User determines the amount of Personal Data transferred from social media independently. Antiplagiat.Kazakhstan uses their information from social media accounts only in accordance with the privacy settings set by the Users under their social media account. Accordingly, Antiplagiat.Kazakhstan only uses the information to provide Users with the Service at the given moment. Such information, which Users allow the social media to share with third parties, is subject to the privacy settings that Users have set in the social media accounts.

3.2.3.2. If the User uses this method of registration on the Site, Antiplagiat.Kazakhstan also requests the minimum amount of Personal Data about the User, namely the e-mail address. The Personal Data received from social media will be used for the purposes of login or sign-up only.

 

3.2.4. Materials

3.2.4.1. When uploading files for the purpose of using the Antiplagiat-Kazakhstan Services to check the presence of text reuse in the text of the document, Antiplagiat Software compares the text with other documents contained in the database to search for identical fragments of text documents. Antiplagiat-Kazakhstan Software automatically retrieves the author’s name      if it is contained in the text. Antiplagiat-Kazakhstan Software may request the User to provide the name of the author of the text. Users can correct the name of the author of the text. This data is used only to calculate the originality percentage and create the Software Report.

3.2.4.2. By uploading a file to the Site, the User creates the Materials.

3.2.4.3. The User, who is not the author of the text, but uploads it to the Site, is liable in case of using other people’s Personal Data due to its possible presence in the document.

3.2.4.4. Antiplagiat.Kazakhstan has the right to remove the document in case of       receiving claims for the removal of any document illegally used by the User.

3.2.4.5. Materials and Software Reports are saved in the Antiplagiat.Kazakhstan database so that the User can refer to the Software Report, edit it or re-check the Materials. Antiplagiat.Kazakhstan uses the content of Materials only for processing User requests and reporting to the User. Antiplagiat.Kazakhstan neither publishes      nor indexes Materials, except at the direct request of the User.

 

3.3. Data Antiplagiat.Kazakhstan Collects Automatically 

3.3.1. Usage Data

When the User uses the Site, information about (i) the IP addresses of the Users; (ii) log-files; (iii) browser type; (iv) device screen size is automatically collected for the purposes of monitoring the attendance of the Site. 

3.3.2. Cookies and Similar Technologies

3.3.2.1. Antiplagiat.Kazakhstan and its partners may use cookies or similar technologies to analyze trends, administer the Site, track Users’ activity      on the Site. It does not use Cookies for profiling.

3.3.2.2. Cookies do not typically include names and/or email addresses and/or other Personal Data. In fact, they typically contain anonymous information that is required for the better functionality of the Services.

3.3.2.3. Antiplagiat.Kazakhstan uses the following first-party cookies on the Site

3.3.2.4. Users can control whether or not cookies are allowed through their browser. If the User chooses to disable cookies, the browser may limit the use of certain features or functions of the Site or service.

3.3.2.5. Antiplagiat.Kazakhstan may use third-party analytics providers software to better understand the functionality of Antiplagiat-Kazakhstan Software on Users’ devices, including but not limited to, Google Analytics and Yandex.Metrica (collectively “Third Party Analytics Providers”). They collect only anonymous User data. Antiplagiat.Kazakhstan does not link the information within the analytics software to any personal information Users submit within the Antiplagiat-Kazakhstan Services. The information about Users’ use of Antiplagiat-Kazakhstan Services, may be transmitted to and stored by Third-Party Analytics Providers’ servers, which may also be located outside of the European Economic Area.

3.3.2.6. The following are third parties that LLC Antiplagiat.Kazakhstan uses for analytics:

Google Analytics

Google Analytics collects information such as how often Users visit the      Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. Google’s ability to use and share information collected by Google Analytics about their visits to Antiplagiat.Kazakhstan Services is restricted by the Google Analytics Terms of Use (as amended for government websites) and the Google Privacy Policy. Users can prevent Google Analytics from recognizing Users on return visits to this Site by disabling cookies on their browser or mobile device. Antiplagiat.Kazakhstan uses Yandex.Metrica to help understand the usage of the Antiplagiat.Kazakhstan Services. 3.4. Antiplagiat.Kazakhstan does not verify the authenticity of the Personal Data provided by the User. Antiplagiat.Kazakhstan policy is based on the assumption      that the User provides reliable and sufficient personal information to register on the Site.

3.5. The accuracy of the Personal Data provided by the User is presumed unless proven otherwise.

3.6. The User is responsible for the authenticity of the Personal Data specified by him during the registration procedure on the Site, as well as for all consequences, damages, and harm caused to third parties and the Controller arising as a result of this.

 

  1. How Antiplagiat.Kazakhstan Uses Personal Data

4.1. During the processing of Personal Data, the following actions can be taken: collection, recording, systematization, accumulation, storage, change (updating, modification), extraction, use, blocking, deletion.

4.2. The processing of Personal Data is carried out by the Processor by maintaining databases in an automated manner or by other lawful means. Personal Data is stored on servers located in the European Union.

4.3. Users, regardless of the applicable mode, submit their Consent to the processing of Personal Data for each of the specified processing purposes. Antiplagiat.Kazakhstan keeps the Consent  before the withdrawal or until the receipt of the notice of the removal of the data. From the moment of receiving a request from the User, Antiplagiat.Kazakhstan takes all possible measures to remove the User’s data as soon as possible.

4.4. Antiplagiat.Kazakhstan has the right to change the terms of this Privacy Policy      in case of changes in the methods of collection, storage, and processing of Personal Data, as well as in case of changes in the requirements of the current legislation on Personal Data or by the decision of Antiplagiat.Kazakhstan. In case the User does not agree with the new edition of the Privacy policy, the User has the right to withdraw his consent in the order established by Section 5.

4.5. Personal Data is not available to other Users of the Site. 

 

  1. How To Exercise Personal Data Rights

5.1. Users have certain choices available to them when it comes to their information. Below is a summary of those rights, how to exercise them, and any limitations.

5.2. Delete User’s Data (Right to Erasure): In certain territories (including the European Union) Users can ask Antiplagiat.Kazakhstan to erase or delete all or some of their Personal Data (e.g. if it is no longer necessary to Provide Services to Users). As a result of deleting their Account, Users will lose access to most Antiplagiat- Kazakhstan Services, including the Account access and information linked to the Account.

5.3. Right to Object: In certain territories (including the European Union) where the processing of their Personal Data is based on legitimate interests, Users can use their right to object at any time. If Users object, Antiplagiat.Kazakhstan will no longer process their Personal Data unless there are compelling and prevailing legitimate grounds for the processing, or the data is necessary for the establishment, exercise, or defense of legal claims.

5.4. Access User’s Data (Right of Access): Upon their request, Antiplagiat.Kazakhstan will provide Users with a copy of their Personal Data in a structured, electronic format.

5.5. Change or Correct User’s Data (Right to Rectification): Users can edit some of their Personal Data through their account. Users can also ask Antiplagiat.Kazakhstan to change, update or correct their data in certain cases, particularly if it’s inaccurate.

5.6. Users have the right to request a copy of their information, to object to Antiplagiat.Kazakhstan use of their information, to request the deletion or restriction on the use of their information, or to request their information in a structured, electronic format.

5.7. For European Union Users only. Data Portability: Data portability is the ability to obtain some Personal Data in a format that Users can move from one service provider to another (for instance, when Users transfer their email address to another carrier). Depending on the context, this applies to some, but not to all      user data.

5.8. Users can exercise their right by following these steps:

5.8.1. User needs to log in to his account using an e-mail address and password or social media account;

5.8.2. User selects the “Profile” menu item in the navigation bar to open the user profile and perform the necessary actions with Personal Data;

5.8.3. User can apply to the Antiplagiat.Kazakhstan to access and perform other activities with their Personal Data by contacting the Data Protection Officer at the e-mail address dpo@antiplagiat.com The Antiplagiat.Kazakhstan responds to requests within 30 calendar days. In case of need to delete Personal Data, Antiplagiat does it as soon as possible. If Antiplagiat.Kazakhstan is unable to deal with Users’ requests fully within a calendar month (due to the complexity or the number of requests), Antiplagiat.Kazakhstan may extend this period by two more calendar months. Should this be necessary, Antiplagiat.Kazakhstan will explain the reasons for such a delay. If Users make their request electronically, Antiplagiat.Kazakhstan will, where possible, provide the relevant information electronically unless otherwise requested by the User.

5.9. Users’ requests and choices may be limited in certain cases, such as when fulfilling their request would reveal information about another person, or if Users ask to delete information which Antiplagiat.Kazakhstan is permitted to keep by law or due to their compelling legitimate interests.

 

6.1. Security Safeguards

6.1. Antiplagiat.Kazakhstan strictly follows the privacy rules of the Personal Data of all Site Users.

6.2. Antiplagiat.Kazakhstan takes all necessary measures to protect Personal Data provided by the User from unauthorized access, alteration, disclosure, or destruction, including: provides continuous internal verification of data collection, storage and processing processes and security; provides physical security of the data, preventing unauthorized access to the technical systems providing the work of the Site, in which the Processor stores Personal Data; provide access to Personal Data only to those employees of the Antiplagiat.Kazakhstan or authorized persons that need access to this information for the performance of labor duties, as well as the exploitation, development, modification, changes, and improvement of the Site.

6.3. The information publicly disclosed by the User, as well as information that can be received by the parties or third parties from sources to which there is free access to any person is not confidential.

6.4. Antiplagiat.Kazakhstan never sends any e-mails to the User with a request to indicate (excluding situations when the Antiplagiat.Kazakhstan asks for confirmation of the first entered data) or otherwise provide the Processor their e-mail address and password when registering on the Site or log in, or the details of access to other social media accounts.

6.5. In case the User loses the details of access to the Site (e-mail address and/or password), Antiplagiat.Kazakhstan can send the User a message with the details lost. In order to receive the message, the User should request the support service. The user receives the requested data at the e-mail address specified during registration on the Website or at the specified e-mail address in the User’s request.

6.6. The Controller and the Processor take the necessary measures or ensure their acceptance of the protection of Personal Data from unauthorized access, the result of which can be the destruction, modification, blocking, copying, provision, distribution of Personal Data, as well as other illegal actions in their processing. At the same time, the Controller and the Processor shall not be liable for the safety of Personal Data in the event of hacking of their protection by intruders (third parties) using technical and other means and capabilities, as well as in case of the transfer or failure of the User to exercise due diligence in the matter of preserving his Personal Data.

6.7. Users must analyze the text for the presence of state, commercial, tax, medical, banking, and other classified information before uploading the document to the Site and, in case of its presence in  the document, assess the possibility of placing the document on the Site. Due to the specifics of the site’s service, Antiplagiat-Kazakhstan does not have the ability to analyze the text. In case of disclosure of information constituting a state, commercial, tax, medical, banking, or other      secret by posting text on the Site, the responsibility is assigned to the User. If      Antiplagiat.Kazakhstan suffers adverse consequences in connection with the User’s disclosure of information  constituting a public, commercial, tax, medical, banking, or another secret, Antiplagiat.Kazakhstan has the right to demand compensation for damages by the User.

6.8. Antiplagiat.Kazakhstan endeavors to keep their Personal Data safe and secure at all times.

6.9. Antiplagiat.Kazakhstan data storage is organized using reliable physical, digital, and procedural safeguards in place to protect Users Personal Data, including the use of SSL encryption, redundant servers, and data centers, and sophisticated perimeter security.

6.10. Antiplagiat.Kazakhstan continuously audits for security vulnerabilities and makes software patching a priority. The password is required to access the Site services and Personal Data, therefore, Users should keep the password confidential.

 

  1. Age limit

7.1. Users under the age of 16 years are not allowed to register on the Site.

7.2. Antiplagiat.Kazakhstan does not knowingly request, process, or store information about the date of birth of the User and his age.

7.3. In case of detection of violation of the age limit by Users, Antiplagiat.Kazakhstan immediately stops processing such User’s Personal Data.

7.4. If Users believe that Antiplagiat.Kazakhstan might have any data from or about a child under the age of 16, they may contact Antiplagiat.Kazakhstan.

 

  1. Advertisement

8.1. Antiplagiat.Kazakhstan does not advertise on its Site.

8.2. Antiplagiat.Kazakhstan does not send advertising messages to its Users.

8.3. Antiplagiat.Kazakhstan places advertisements of its services on various sites on the Internet. Antiplagiat.Kazakhstan cooperates with third parties to manage advertising on other sites. It is subject to the privacy policy that is set on other sites.

 

  1. Period of Validity of the User’s Consent to the Personal Data Processing

9.1. Antiplagiat.Kazakhstan stores the User’s data until the Account is deleted and is necessary for the provision of services to the User.

9.2. Antiplagiat.Kazakhstan has the right to delete the Account and all the data upon the expiry of the Licensing period or in case the User violates the terms and conditions of the Licensing Agreement.

9.3. Users may withdraw consent where the processing of their Personal Data is based on consent, by contacting Antiplagiat.Kazakhstan as explained in Section 11. If Users withdraw their consent, it will not affect the lawfulness of processing based on their consent before its withdrawal.

 

  1. Changes to This Privacy Policy

10.1. Due to the fact that the legal requirements for data confidentiality can be changed, supplemented, Antiplagiat.Kazakhstan reserves the right to amend this Privacy policy as necessary and in accordance with the requirements of the law.

10.2. Antiplagiat.Kazakhstan will post any privacy policy changes on this page and, if the changes are significant, Antiplagiat.Kazakhstan will provide more prominent notice by adding a notice within the Software or by sending its Users an email notification.

10.3. Antiplagiat.Kazakhstan encourages Users to review this Privacy Policy whenever Users use the Services to stay informed about Antiplagiat.Kazakhstan information practices and the ways Users can help protect their privacy.
